Diaspora Link — Terms of Service

1. Acceptance and Scope

1.1 Operator Status

Diaspora Link is currently operated by a private individual and is not incorporated. You acknowledge that the Platform is operated on a limited liability basis.

1.2 Additional Policies

By using the Service, you also agree to:

1.3 Modifications

We reserve the right to modify these Terms at any time. Material changes effective 30 days after notice via email or in-app notification. Continued use constitutes acceptance.

2. Eligibility and Age Requirements

YOU MUST BE AT LEAST 13 YEARS OLD TO USE THE SERVICE.

By creating an account, you represent and warrant that:

• You are at least 13 years of age
• If 13-17, you have parental/guardian consent
• If under 18, you will not use features requiring adult capacity
• You have provided accurate age information

We do not knowingly collect information from children under 13. If we discover an account belongs to a user under 13, we will immediately terminate it and delete all data.

2.2 Account Registration

To use certain features, you must create an account by providing:

• Accurate personal information (name, location, date of birth)

You agree to:

• Keep information updated: Update promptly if it changes

3. Purpose and Nature of the Platform

3.1 Platform Description

Diaspora Link is a community-driven marketplace allowing users to:

• Create and view posts, comments, and community content
• Search for and post job opportunities
• List and search for housing rentals
• Coordinate ride-sharing arrangements
• Send end-to-end encrypted messages
• Join location-based communities

3.2 Intermediary Role — Critical Disclaimer

DIASPORA LINK IS AN INTERMEDIARY PLATFORM ONLY. WE FACILITATE CONNECTIONS BUT DO NOT PARTICIPATE IN, CONTROL, VERIFY, ENDORSE, OR GUARANTEE ANY TRANSACTIONS, AGREEMENTS, OR ACTIVITIES BETWEEN USERS.

We are NOT:

• An employer, recruiter, staffing agency, or HR service
• A landlord, property manager, or real estate broker
• A transportation provider, taxi service, or ride-sharing company
• A financial institution, payment processor, or escrow service
• A provider of legal, immigration, tax, or professional advice
• A verifier of identities, credentials, or background checks
• A guarantor of safety, quality, or legality

All interactions between users occur solely at the discretion and risk of the users involved.

4. User Responsibilities

4.1 Compliance with Laws

You agree to:

• Comply with all local, state, federal, and international laws
• Obtain necessary licenses, permits, and insurance for your activities
• Pay all applicable taxes
• Ensure compliance with labor laws, fair housing laws, consumer protection

4.2 Accuracy of Content

You represent and warrant that:

• All information you provide is accurate, truthful, and not misleading
• You have the right to share all content you post
• Your content does not violate any third-party rights
• You will update or remove content if it becomes inaccurate

4.3 Due Diligence

YOU ARE SOLELY RESPONSIBLE FOR:

• Verifying identity, credentials, and background of users you interact with
• Conducting inspections, interviews, background checks, reference checks
• Ensuring compliance with applicable laws
• Assessing safety risks before meeting users in person
• Making informed decisions about transactions and arrangements

5. Prohibited Conduct

You agree NOT to:

Illegal Activity

• Violate any law, regulation, or ordinance
• Engage in fraud, scams, phishing, or identity theft
• Post illegal goods or services
• Facilitate human trafficking or exploitation
• Engage in money laundering or terrorist financing

Harmful Content

• Post defamatory, libelous, obscene, or pornographic content
• Share violent, gory, or cruel content
• Post hate speech, threats, harassment, or discriminatory content
• Share content glorifying illegal or harmful activities
• Post child sexual abuse material (CSAM)

Fraud and Deception

• Impersonate any person or entity
• Create fake accounts, listings, or reviews
• Engage in "bait and switch" schemes
• Post false job opportunities or fake housing listings
• Use Platform for phishing or social engineering

Consequences

Violations may result in:

• Immediate content removal without notice
• Account suspension (temporary or permanent)
• Account termination with no appeal
• Reporting to law enforcement
• Legal action

10. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability, fitness for a particular purpose
• Warranties that Service will be uninterrupted, error-free, or secure
• Warranties regarding accuracy or reliability of User Content

YOU USE THE SERVICE AT YOUR OWN RISK.

11. Limitation of Liability

OUR TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF: (A) $25 USD, OR (B) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

WE ARE NOT LIABLE FOR:

• Lost profits, revenue, or business opportunities
• Loss of data or goodwill
• Personal injury, death, or property damage
• User Content or actions of users
• Fraud, scams, or criminal activity by users
• Disputes between users (employment, housing, ride-sharing)
• Accidents, injuries, or death from ride-sharing

12. Indemnification

You agree to defend, indemnify, and hold harmless Diaspora Link from all claims arising from:

• Your use of the Service or violation of these Terms
• Your User Content
• Your interactions with other users
• Your violation of any law or regulation

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before filing any legal claim, you must first attempt to resolve the dispute informally by contacting contact@diaspora-link.com.

13.2 Binding Arbitration

IF INFORMAL RESOLUTION FAILS, ALL DISPUTES WILL BE RESOLVED THROUGH BINDING INDIVIDUAL ARBITRATION, NOT COURT LITIGATION.

13.3 Class Action Waiver

YOU AGREE TO BRING CLAIMS ONLY IN YOUR INDIVIDUAL CAPACITY, NOT AS A CLASS ACTION OR REPRESENTATIVE PROCEEDING.

13.4 Opt-Out Right

You may opt out of arbitration within 30 days of accepting these Terms by emailing contact@diaspora-link.com with: "I opt out of the arbitration agreement in the Terms of Service"

You further acknowledge that:

• You are at least 13 years old
• You understand the disclaimers, waivers, and liability limitations
• You agree to arbitrate disputes and waive jury trial and class actions
• You assume all risks associated with using the Service
